Code of Conduct & Ethics Training

The Federal Sentencing Guidelines make it clear that organizations can be liable for their employees' actions and give strong incentive for employers to take proactive action to prevent unethical and illegal conduct.

The Federal Sentencing Guidelines apply to all organizations whether publicly or privately held.  These include corporations, LLC’s, labor unions, nonprofit entities, governmental units, unions, pension funds, and trusts.

The new guidelines make it clear that organizations can be held liable for their employees' illegal actions.  They give strong incentive for employers to take proactive action to prevent unethical and illegal conduct.  They state that all organizations must train all employees on workplace ethics and compliance.  They also state that those organizations that can demonstrate that they instituted an effective compliance and ethics program will greatly reduce the potential fines and other punishments they may face for a criminal conviction.
